A.21 www.masteritaly.com 1/2 CONDIZIONI DI VENDITA CONDITIONS OF SALE 4 RECLAMI E DIFETTOSITÀ PRODOTTI Qualora al ricevimento dei Prodotti, il Cliente verifichi la non conformità, eventuali reclami per vizi e difetti apparenti e non dei Prodotti dovranno essere propo- sti per iscritto dal Cliente entro 8 (otto) giorni dalla scoperta dei vizi ed i particolari difettosi dovranno es- sere resi a MASTER, unitamente alla prova di acquisto (fattura e bolla di vendita). MASTER, a seguito della segnalazione ricevuta, si riserva di effettuare una pro- pria valutazione sulla base dei campioni forniti ed ove necessario di sopralluogo. Qualora ne venga accertata la difettosità, gli eventuali pezzi riconosciuti difettosi saranno sostituiti a cura e spese di MASTER. Nessun agente e/o distributore e/o ogni altro intermediario di MASTER è autorizzato ad offrire garanzie ulteriori rispetto a quelle contenute nelle presenti CGV. In ogni caso la responsabilità di MASTER e dei suoi agenti e/o distributori e/o ogni altro intermediario, è limitata all’importo massimo del prezzo di vendita del Prodot- to. Restano escluse le spese relative alle operazioni di rimozione e/o sostituzione del prodotto oggetto di un eventuale segnalazione. 5 VARIE MASTER si riserva il diritto di variare senza alcun pre- avviso le caratteristiche degli articoli presenti in ca- talogo, allo scopo di adeguarli ad esigenze di natura tecnica e/o commerciale. L’eventuale utilizzo nel Ca- talogo e nel Listino di marchi e/o segni distintivi di proprietà di terzi risponde allo scopo di indicare la destinazione dei Prodotti in conformità con quanto previsto dall’art 21 comma 1 D.Lgs. 30/2005. 6 LEGGE APPLICABILE E FORO COMPETENTE Salvo diversa pattuizione scritta tra le parti, la vendita tra MASTER ed il Cliente è regolata dalla Legge Italia- na e la risoluzione di ogni controversia sarà devoluta in via esclusiva al Foro di Bari. 4 COMPLAINTS AND PRODUCT DEFECTS Should Clients note a non-conformity on receipt of Products, any complaint for faults or defects of Pro- ducts, be they manifest or not, must be submitted in writing by the Client within 8 (eight) days of discovery of the faults, and the details of the defects must be submitted to MASTER, together with the proof of pur- chase (invoice and bill of sale). MASTER, following re- ceipt of the notification, reserves the right to carry out an evaluation on the basis of samples supplied and, where necessary, with a site visit. On confirmation of the defect, any items recognized as defective will be substituted at the expense of MASTER. No agent and/ or distributor and/or any other MASTER intermediary is authorized to offer guarantees exceeding those contained in this GCS. In any case, the responsibili- ty of MASTER and its agents and/or distributors and/ or any other intermediary, is limited to the maximum retail price of the Product. Expenses relating to ope- rations of removal and/or substitution of the product subject to the notification are excluded. 5 VARIOUS MASTER reserves the right to vary the characteristics of those articles contained in the catalogue without warning, with the aim of adapting them to technical and/or commercial requirements. Any use within the Catalogue of trademarks and/or distinctive signs whi- ch are the property of third parties, is exclusively for the aim of indicating the function of Products in con- formity with the provisions of article 21, paragraph 1, of Legislative Decree 30/2005. 6 APPLICABLE LAWS AND COMPETENT COURT Unless agreed otherwise in writing between the par- ties, the sale between MASTER and the Client is go- verned by Italian law and the resolution of any dispute will devolved exclusively to the Court of Bari.
